If you are the victim or have been charged with domestic violence there are a few things you should be aware of:
- It is not up to the victim to "drop the charges". The Prosecutor's office can and usually does go forward with domestic violence cases regardless of whether the victim wants the charges dismissed.
- It is not up to the victim to "drop the temporary protection order". Each case will be reviewed by the Judge and protection orders will be issued upon the decision of the Judge. Just because a victim does not request or desire a protection order, doesn't mean that one will not be issued.
- If you are a victim, you have the right to submit a "Victim Impact Statement" to the Court. The Victim Advocate's Office can assist you in preparing this statement.
